Product Warranty & Liability*
- We hereby warrant our Products against defects in material and workmanship arising solely from the manufacturing process for a period of 12 months from the date of shipment shown on the relevant transport document. During the warranty period, our obligation and liability shall be limited, at our sole discretion, to either:
- Replacement of the defective Product(s) or issuance of a reimbursement or credit note equivalent to the original invoice value of the defective Product(s)
- Any replacement, reimbursement or credit note shall be limited to the original invoice value of the defective Product(s) and shall not include any freight, transportation charges, shipping charges, duties, taxes, handling charges, installation or removal costs, inspection charges, labor costs, field service costs, downtime losses, production losses, recall costs, campaign costs, loss of profit, loss of business, or any other incidental, consequential or related expenses.
- Except for defects attributable solely to manufacturing defects and fitment-related non-conformities, we do not provide or assume any performance guarantee or product liability, whether expressed or implied
- Notwithstanding anything contained elsewhere in any applicable Agreement, our total aggregate liability arising out of or in connection with this warranty or the Products supplied, whether under contract, warranty, indemnity, statute or otherwise, shall in no event exceed the original invoice value of the defective Products giving rise to the claim.
- Under no circumstances shall we be liable for any indirect, consequential, incidental, special, exemplary, punitive or third-party losses, damages, claims, liabilities, costs or expenses arising out of or in connection with the use, installation, application or performance of the Products supplied.
- The warranty shall not apply to, and we shall have no liability for, any defects, damages, failures or non-conformities arising directly or indirectly from:
1. Improper fitment or installation;
2. Misuse, negligence, mishandling, abuse, improper application or operation;
3. Poor or improper storage conditions;
4. Abnormal operating conditions;
5. Normal wear and tear arising from regular usage;
6. Electrical fluctuations, overheating, accidents or external impacts, Unauthorized repairs, servicing, alterations or modifications carried out by the end user or any third party or Any external factors or circumstances beyond our reasonable control.
- Any party seeking to make a warranty claim shall promptly notify us in writing of the alleged warranty claim and shall provide us with a reasonable opportunity to inspect, investigate and jointly analyse the alleged defective Product(s) before any corrective action, replacement or claim is initiated. No warranty claim shall be valid unless failure analysis establishes that the defect is solely attributable to our manufacturing process.
